A legal state of insolvency. A company deemed to be in this condition may choose protection under the law to allow a chance to reorganize (Chapter 11) or liquidate in an orderly fashion (Chapter 7).A company deemed to be bankrupt may choose protection under the law to allow a chance to reorganize (Chapter 11) or liquidate in an orderly fashion (Chapter 7). In the past few years, the improper use of the Bankruptcy Code's Chapter 11 provisions by larger corporations has put companies in similar situations under strict scrutiny. For this reason, it's recommended that you consult a competent bankruptcy attorney in order to understand just what's involved and to ensure you file all proper paperwork. Additionally, you should plan on taking from two to four years to complete the judicial cycle of Chapter 11 proceedings.

What are different types of bankruptcy:


Chapters: There are six types of bankruptcy under the Bankruptcy Code, located at Title 11 of the United States Code:-

Chapter 7: basic liquidation for individuals and businesses
Chapter 9: municipal bankruptcy
Chapter 11: rehabilitation or reorganization, used primarily by business debtors, but sometimes by individuals with substantial debts and assets
Chapter 12: rehabilitation for family farmers and fishermen
Chapter 13: rehabilitation with a payment plan for individuals with a regular source of income
Chapter 15: ancillary and other international cases

The most common types of personal bankruptcy for individuals are Chapter 7 and Chapter 13.Corporations and other business forms often file under Chapter 7 or Chapter 11.
